What is a Separation Agreement/Minute of Agreement?

A Separation/Minute of Agreement is a formal written legal contract between a couple who have already, or plan to, stop living with one another and is ideal for couples who are keen to separate and make the necessary arrangements amicably. The document helps lay out agreements made around finances (pension share, savings, investments), assets, property (for example the family home) and of course, arrangements for any children involved.

Benefits:

Avoids court action (only end up in court if you cannot reach an agreement to get it signed off)
Time is taken to review the matrimonial assets and debts and negotiations take place around how those are to be fairly divided (a court will not grant a decree of divorce if there are any disputes in relation to finances or the children of the marriage)
The benefit of having this agreement written down is that it makes it easier for both parties to understand what has been agreed and to have approved the document
The agreement is legally binding
Once the divorce is granted it resolves all the finances and issues in respect of children.

Some examples of what might be included in a Separation/Minute of Agreement are:

To agree to live apart and who will live in the family home (if applicable)
To provide financial support or maintenance to the other partner
To provide financial support for any children
Who children should live with and have contact with
Who gets what…i.e paintings, vehicles, belongings etc.
