In Scotland, there are two main types of Power of Attorney:

  2. Welfare Power of Attorney – This comes into effect only if you become unable to make your own personal/welfare decisions and covers areas such as medical treatment and care.
  3. A Combined Power of Attorney combines the two into one document, covering both financial and welfare matters. Most people put this document in place to cover any eventuality.

The best time to set up a Power of Attorney is now – while you are still mentally capable of making legal decisions. Waiting until you are in a crisis can make the process more difficult, and in some cases, too late. It is a misconception that Powers of Attorney are only for the elderly – they could be relied upon at any time and can be useful even if your capacity is not yet a concern.

How to Set Up a Power of Attorney

Setting up a Power of Attorney in Scotland involves the following steps:

  1. Choosing your Attorneys/Trusted individuals – This should be individuals you trust, such as  family members or close friends.
  2. Drafting the POA document – A Solicitor can help ensure it meets legal requirements and grant all the necessary powers to allow your attorneys to make decisions on your behalf.
  3. Signing in the presence of a Solicitor or Doctor – This confirms that you understand the document, have capacity to put it in place and are signing voluntarily.
  4. Registering with the Office of the Public Guardian – The PoA must be registered before it can be used.
